This license is dedicated to supporting the Anu Initiative’s mission of environmental conservation and fostering a community-driven approach to ecological restoration. It aims to ensure that the software, data, and resources provided under this license contribute positively to environmental sustainability and are used in a manner consistent with the values of Transparency, Passion, Integrity, Commitment, and Community.
1. Definitions
- “The Product” refers to any software, data, documentation, or other materials released under this license.
- “The Organization” refers to the Anu Initiative Company Limited by Guarantee, incorporated in the Republic of Ireland.
- “Contributor” refers to any individual or entity that provides material under this license.
2. Grant of Rights
- The Organization grants you a worldwide, royalty-free, non-exclusive license to use, modify, and distribute The Product in source or binary form, provided that you comply with the terms of this license.
3. Conditions of Use
- You must include a copy of this license with any distribution of The Product.
- Any modification or derivative work of The Product must also be made available under this same license.
- You must provide clear attribution to the Anu Initiative and any Contributors in any derivative works or distributions of The Product.
4. Environmental Responsibility Clause
- You must use The Product in a way that positively contributes to environmental conservation and sustainability.
- You shall not use The Product in any way that significantly harms the environment, as determined at the discretion of the Organization.
5. Transparency and Reporting
- If you use The Product for projects that positively impact the environment, you are encouraged to report your activities and impacts to the Organization, fostering a community of partnership, transparency and shared progress.
6. Disclaimer of Warranty and Liability
- The Product is provided “as is”, without warranty of any kind, express or implied.
- The Organization shall not be liable for any claim, damages, or other liability arising from the use or inability to use The Product.
7. Termination
- This license and the rights granted hereunder will terminate automatically if you fail to comply with the terms herein.
8. Penalties for Breach
In the event of a breach of this license, the infringing party shall be subject to two of the following ecologically oriented sanctions of their choice, which, despite their whimsical nature, shall be binding and enforceable:
a. Tree Hugging Hours: The infringer shall be required to engage in no less than ten (10) hours of Tree Hugging, wherein the infringer shall physically embrace various species of trees within a designated conservation area, fostering a literal connection with nature. Such activities must be documented and submitted to the Organization in a form that may include, but is not limited to, photographic evidence or affidavits from woodland creatures.
b. Eco-Penance Pilgrimage: The infringer must undertake an Eco-Penance Pilgrimage, walking to a nearby natural reserve or park, whilst picking up litter along the route. The distance of this pilgrimage shall not be less than ten (10) kilometers, ensuring a substantial contribution to environmental cleanliness and personal reflection on the breach.
c. Sustainable Sonnets: The infringer shall compose and publicly perform no fewer than three (3) sonnets dedicated to the beauty of nature, the importance of sustainability, and the error of their ways. These performances must occur in community centers, schools, or other public venues, with the aim of spreading environmental awareness and fostering a culture of conservation.
d. Wildlife Waltz: The infringer shall participate in a Wildlife Waltz, a dance event organized specifically for the purpose of this penalty, where participants express their apology through interpretative dance mimicking various endangered species. This event will be open to the public and aimed at raising awareness about the plight of these species.
e. Conservation Contribution: In addition to the aforementioned activities, the infringer shall make a donation to a conservation project approved by the Organization, the sum of which shall be no less than the equivalent value of one hundred (100) hours of the infringer’s time, calculated at their current hourly rate or the prevailing minimum wage, whichever is higher.
These penalties are designed to not only redress the breach in a manner consistent with the spirit of this license but also to educate the infringer on the importance of environmental conservation, thereby turning a negative into a positive for our planet.
All penalties must be carried out within ninety (90) days from the moment the infringer gets legally notified. Failure to comply will result in litigation.
8. General
This license does not grant permission to use the trade names, trademarks, service marks, or product names of the Organization, except as required for reasonable and customary use in describing the origin of The Product.
